Agreeing to these terms

These terms and conditions apply to your use of drctractors.co.za and to anything you buy from DRC TRACTORS. By using our website, requesting a quote or placing an order, you agree to these terms. If you do not agree, please do not use the website or place an order.

Nothing in these terms limits your rights under the Consumer Protection Act 68 of 2008 or any other law that cannot be limited by agreement.

Using our website

You agree to use our website lawfully and honestly. You must not try to gain unauthorised access to the website, interfere with its operation, copy it automatically in a way that harms it, or use it to send spam or harmful code. We may suspend or block access if you break these rules.

If you create an account, you must give us correct information and keep your password safe. You are responsible for activity on your account.

Products and descriptions

We try to describe and photograph our products as accurately as we can, including the make, model, year, hours, horsepower and condition. Photos are for illustration, and small differences in colour, accessories or appearance can occur, especially with used machines.

Specifications and descriptions sometimes come from the manufacturer or previous owner. If a detail matters to your decision, please ask us to confirm it before you buy.

Used machinery and equipment

Used tractors, implements and equipment have been owned and worked before. They are sold in the condition described in the listing, and normal wear and tear is to be expected. We encourage you to inspect any used machine before you buy. Contact us to arrange a viewing.

This does not take away any rights you have under the Consumer Protection Act, for example if goods are not of the quality you are entitled to expect, or if we misdescribed them.

Prices and availability

All prices are in South African rand (ZAR). We will tell you on the product page or in your quote if a price excludes VAT or other costs, such as delivery.

Prices and stock can change without notice. Because many of our products are single items, a product may be sold before your order is confirmed. If we made an obvious pricing or listing error, we may correct it and give you the choice to proceed at the correct price or cancel, with a full refund of anything you have paid.

Quotes and orders

A quote is an offer to sell at the stated price for the period we tell you. Placing an order or accepting a quote is your offer to buy. A binding contract is formed only when we confirm your order in writing, for example by email, and, where required, receive your payment.

We may decline or cancel an order, for example if the goods are no longer available, if we cannot deliver to your address, or if we suspect fraud. If we cancel after you have paid, we will refund you in full.

Payment

We will tell you which payment methods we accept when we confirm your order. Goods are normally released only after we have received full payment in cleared funds, unless we agree otherwise in writing. Payments through our website are handled by payment service providers, and you must be authorised to use the payment method you choose.

Warranty

Where a product listing states a warranty, it applies as described in that listing. Please ask us for the full warranty terms for the machine you want before you buy. Warranties do not cover damage caused by misuse, lack of maintenance, accidents, unauthorised repairs or normal wear and tear.

Ownership and risk

Ownership of the goods stays with DRC TRACTORS until we have received full payment. Risk of loss or damage passes to you on delivery or collection, as set out in our shipping page.

Our liability

We are responsible for our goods and services as the law requires. To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profit or lost use of a machine, that arise from your use of our website or goods. We are also not liable for delays or failures caused by events outside our reasonable control, such as severe weather, strikes, transport disruption or power failures.

Nothing in these terms excludes liability that cannot be excluded by law, including for gross negligence or fraud.

Intellectual property

The content on our website, including the DRC TRACTORS name, logo, text, design and our own photos, belongs to us or is used with permission. You may view and print it for your own personal use, but you may not copy, sell or republish it without our written permission.

Privacy

We handle your personal information as described in our Privacy Policy.

Links to other websites

Our website may link to websites run by others. We do not control them and are not responsible for their content or practices.

Governing law and disputes

These terms are governed by the laws of South Africa. If you have a complaint, please contact us first so we can try to resolve it quickly and fairly. If we cannot, you may approach the National Consumer Commission, the relevant consumer or industry ombud, or the South African courts.

Changes to these terms

We may update these terms from time to time. The version on this page is the current one and applies to orders placed after the change. Orders already confirmed stay under the terms that applied when they were confirmed.
